RE: The tariff classification of gloves from China

Dear Ms. Desjardins:

In your letter dated March 2, 2016, you requested a tariff classification ruling on behalf of your client, Ringer Gloves.

The sample submitted style 075-10 is a coated string-knit gauntlet work glove constructed from 64% aramid, 23% cotton, and 13% glass fiber. The glove’s outer surface is dip coated in polyvinylchloride, then thermoplastic rubber molding is added to the back side of the glove and then coated again with polyvinyl chloride plastic. You have indicated that the coated glove does not contain 50% or more by weight of textile fibers.

The applicable subheading for this style will be 6116.10.6500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other. The duty rate will be 7% ad valorem.

You assert that the gloves are classified under subheading 3926.20.1050, HTSUS, however, the gloves are not classified as a plastic good of chapter 39.  Legal Note 2(a) to Chapter 59, HTSUS, is noted.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
